Federal Requirements Related to Foreign Influence:
In January of 2021, the White House issued NSPM-33 which directs federal agencies and departments to focus on improving the security of the research enterprise. Specifically, NSPM-33 focuses on:
- Adopt and standardize, where possible, disclosure requirements across agencies
- Require recipients of funding to use Digital Persistent Identifiers
- Document consequences for violation of disclosure requirements
- Share information between agencies
- Require recipients of federal funding to implement Research Security programs
In January 2022, Guidance for Implementing NSPM-33 as issued to federal agencies and requires that Research Security programs contain the following elements:
- Foreign Travel security
- Cybersecurity
- Research Security training
- Export Control training
- CHIPS + Science Act (2022)
- Federal Sponsor Requirements related to Disclosures
- Cybersecurity
- CUI/NIST 800-171
- Export Control Regulations
- Department of State, (Directorate of Defense Trade Controls)– International Traffic in Arms Regulations
- Department of Commerce, (Bureau of Industry and Security)– Export Administration Regulations
- Department of the Treasury, Office of Foreign Asset Controls (OFAC)–Sanctions and Embargoes
- Exports of specific items, materials, and/or biologics may also be regulated by other agencies such as: DOE, NRC, FDA, USDA/ APHIS, etc.

- Higher Education Act (HEA) Section 117 Foreign Source Reporting
- NSF reporting requirements for foreign gifts
- Prohibition on certain telecommunications equipment
- Committee on Foreign Investment in the United States (CFIUS) reporting requirements
